Compliance after registration

Risk profiling for Investment Advisers

An Investment Adviser cannot advise a client until the client's risk profile is complete and the client has agreed to it. The advice then has to suit that profile. We draft the risk-profiling forms and the consent step.

Who it applies to

What the rule says
  • Risk profiling is done and the client's consent on the completed risk profile is taken before any advice is given.
  • The advice given must be suitable to that risk profile.
  • KYC is done through a KYC Registration Agency.
What we do
  • Draft the risk-profiling questionnaire and the scoring that turns answers into a profile.
  • Draft the consent step that records the client's agreement to the completed profile.
  • Set up a suitability record so each piece of advice can be traced to a profile.
  • Place the forms in your onboarding flow and your agreement.
What we need from you
  • The products and services you advise on.
  • Your current onboarding steps and any questionnaire already in use.
  • Your client categories.

Questions
Does this apply to Research Analysts?

No. Risk profiling and suitability are Investment Adviser obligations. A Research Analyst does not advise individual clients on their portfolios.

When does the profile have to be done?

Before any advice. The client also consents to the completed profile before advice is given.

Does BuildWright decide the client's risk profile?

No. The forms collect the client's answers and record the client's consent. The adviser remains responsible for the advice and its suitability.
