Professional Tax shows up on payslips and registration checklists with almost no explanation attached. Founders often assume it applies everywhere, the way GST or TDS does. It doesn't. It's a state tax, and close to a third of India's states and union territories don't levy it at all.
Professional Tax is a state-level tax. Whether you owe it depends on where your business or employees are located, and your company's incorporation state has nothing to do with that. Around 20 states and union territories levy it, including Maharashtra, Karnataka, West Bengal, Gujarat and Tamil Nadu. Delhi, Haryana (Gurugram), Uttar Pradesh (Noida), Rajasthan and Punjab don't. If none of your offices or employees sit in a state that levies it, you have no obligation yet. That changes the moment you hire someone who works from one.
What Professional Tax actually is
Article 276 of the Constitution lets state governments tax professions, trades, callings and employment, and caps the total any one person can be charged across every state and local authority combined at ₹2,500 a year. The cap used to be ₹250. The Constitution (Sixtieth Amendment) Act, 1988 raised it to ₹2,500, and it has stayed there since. Because Article 276 hands this power to states rather than the centre, there's no single national list or portal for it. Each state runs its own Act, its own slab, its own due dates, and treating one state's rules as universal is the most common mistake we see.
PTEC vs PTRC, in one paragraph
PTEC, the Professional Tax Enrolment Certificate, covers your own liability as an entity or a self-employed professional. It's a flat annual payment with no periodic return attached. PTRC, the Professional Tax Registration Certificate, covers your liability as an employer. It authorises you to deduct PT from employee salaries and remit it, usually every month. A company or LLP with staff typically needs both. One with zero employees needs only PTEC. Maharashtra is where these two names come from; other states run the same employer-versus-self split under their own terminology.
Which states levy Professional Tax and which don't
Two lists, and the state your business sits in decides everything. Some sources count 20 states, others 21, mostly because of how union territories get counted; the named lists themselves agree.
