Order constituting the Internal Committee under the POSH Act
How do I constitute the Internal Committee under the POSH Act and put it in writing for my staff?
Fill in your details for a free Word and PDF copySection 4(1) of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 says every employer of a workplace shall, by an order in writing, constitute the Committee. Where offices or units are at different places, it asks for one at each. Section 19(b) asks the employer to display the order at a conspicuous place. The order below is that document.
Section 4(2) sets who sits on it. The employer nominates a Presiding Officer, who shall be a woman employed at a senior level at the workplace from among the employees, with fallbacks if none is available. It adds "not less than two Members from amongst employees preferably committed to the cause of women or who have had experience in social work or have legal knowledge", and one member from a non-governmental organisation or association committed to the cause of women, or a person familiar with the issues relating to sexual harassment. At least one-half of the total Members nominated shall be women. The form asks you to confirm this, with the Presiding Officer counted. It cannot count the members, so check it before you sign.
Under section 4(3), the Presiding Officer and every Member hold office for the period you specify, which may run up to three years from the date of nomination. The form accepts 1 to 36 months. Section 26(1)(a) provides a fine which may extend to fifty thousand rupees for failing to constitute the Committee under section 4(1). The order names no fee for the external member, because section 4(4) leaves that to the rules.
