Want your trademark application filed in the right class? We prepare and file it.
Filing a trademark application (Form TM-A) costs ₹4,500 per class online if you are an individual, a startup or a small enterprise, and ₹9,000 per class for everyone else. Physical filing costs ₹5,000 and ₹10,000. Replying to an examination report and attending the hearing carry no official fee. An opposition costs ₹2,700 per class online, and renewal after ten years costs ₹9,000 per class.
Note
These are the fees set by the First Schedule of the Trade Marks Rules, 2017, as IP India publishes them. They are the government's charge only. Any professional fee for preparing and prosecuting the application is separate and is not included.
The fee table
The schedule's note on TM-A says the fee is for each class and for each mark. Online filing is cheaper than paper wherever both are allowed.

An example: a word mark in two classes, filed online, costs ₹9,000 in official fees for an individual or a recognised startup and ₹18,000 for a company that is neither a startup nor a small enterprise. That is our arithmetic from the table.
Who pays the lower TM-A fee
The Rules give the lower fee to an individual, a startup or a small enterprise. A startup is an entity recognised as one under the Startup India initiative. A small enterprise is one whose investment in plant and machinery (for goods) or equipment (for services) does not go above the limit that section 7(1) of the MSMED Act, 2006 sets for a medium enterprise. The TM-A form asks you to attach the certificate for a startup or small enterprise claim, so have it ready before you file.
Objection reply and hearing
After you file, the Registrar examines the application and may send an examination report with objections. The First Schedule has no entry for replying to that report and none for the hearing that follows, so neither carries an official fee. The reply is due within one month of receiving the report, or the Registrar may treat the application as abandoned (rule 33(4)). If the reply does not satisfy the Registrar, or you ask for a hearing, a hearing is held (rule 33(6)).
A fee arises when you file something extra. A request to adjourn a hearing in an opposition goes in Form TM-M with the scheduled fee (rule 50(2)). Apart from expedited examination, TM-M entries run from ₹900 to ₹4,500 online and ₹1,000 to ₹5,000 on paper, depending on the purpose.
Opposition
Once an accepted application is advertised in the Trade Marks Journal, anyone can file a notice of opposition in Form TM-O within four months of the journal's publication (rule 42). The fee is ₹2,700 per class opposed online, or ₹3,000 on paper. If you are the applicant, your counter-statement also goes in Form TM-O within two months of receiving the notice (rule 44), and the same entry in the schedule covers it.
Renewal and late renewal
A registration lasts ten years (section 25(1) of the Trade Marks Act, 1999). Form TM-R can be filed up to one year before it expires (rule 57). The fee is ₹9,000 per class online and ₹10,000 on paper.
If the date passes, the Registrar must not remove the mark when you apply and pay the fee and surcharge within six months of expiry (proviso to section 25(3)). Online, that is ₹9,000 plus ₹4,500 per class, or ₹13,500. After six months and within one year of expiry, the Registrar may restore a mark removed for non-payment on application and payment (section 25(4)). The schedule lists the combined entry as renewal with surcharge or restoration and renewal: ₹9,000 online (₹10,000 on paper) on top of the renewal fee.
What the schedule does not charge
The First Schedule has no separate entry for issuing the registration certificate. After the TM-A fee, the next fee you must pay on an uncontested mark is the renewal at ten years. Choosing the right classes up front matters because a fee is paid for every class you add. Our guide on class 9 and class 42 covers that choice.
Frequently asked questions
Per class and per mark. The schedule's note reads that the fee is for each class and for each mark, so a two-class application for one mark pays twice.
