  • Index
  • Proforma
  • Synopsis with list of dates and events

  • Consumer complaint with affidavit
  • Before you file

A consumer can file a complaint under section 35 of the Consumer Protection Act, 2019 about defective goods, a deficiency in a service, a price charged above the displayed, fixed or agreed price, or an unfair trade practice. The complaint goes to the District Commission when what you paid is up to ₹50 lakh, and the fee is nil up to ₹5 lakh (G.S.R. 912(E), G.S.R. 606(E)).

You file where you live or work (section 34(2)(d)), within two years of the cause of action (section 69). The Act does not ask for a legal notice first. The pack counts your two years from the day the problem arose, which is the safe date.

e-Jagriti asks for an index, a proforma, a synopsis with a list of dates, a memo of parties and the complaint with a notarised affidavit. The pack builds each one from your answers and tells you the upload order.

The Act does not treat a buyer for resale or a business purpose as a consumer, so the pack is built for your own or your family's use, or for goods you use only to earn your own living. Insurance claims have their own bundle.

Common questions

Do I need a lawyer to file?

No. The e-Jagriti FAQ says an advocate is not mandatory, and the bundle is written for you to file in person.

What does it cost to file?

The Commission's fee is nil when you paid up to ₹5 lakh, and rises in steps above that (G.S.R. 606(E)). The proforma shows the fee for your amount.

Can I ask for compensation?

Yes. You can ask for compensation for loss and injury (section 39(1)(d)) and for costs (section 39(1)(m)). The Commission decides what to award.

I bought it for my business. Can I use this?

Not for resale or a business purpose, which section 2(7) leaves out. Goods you use only to earn your own living by self-employment are covered. For other business purchases we look at the facts with you on a call.
