Section 18 of the MSMED Act, 2006 lets a micro or small supplier refer a dispute over delayed payment to the Micro and Small Enterprises Facilitation Council of its state. The Samadhaan home page now sends new applications to the MSME ODR portal, and this pack is the application for one invoice, written under the headings of the portal's statement of claim.
It sets out the seller, the buyer, the order, the invoice, the correspondence and the payments received, then the amount due. Interest under section 16 is worked out up to the date of the application. The pack adds the limitation position and the state whose Council has jurisdiction. For an oral order it also adds the affidavit the Samadhaan FAQ asks for.
You copy each section into the matching box on the portal and upload the documents listed at the end. After filing, the buyer gets three days to reply and the portal offers an optional settlement stage of up to 15 days, or 30 if both sides agree. The Samadhaan portal states that every reference is to be decided within ninety days. If the buyer has raised an open objection to the goods or services, the pack does not build, and we look at the facts with you. We can also do the filing for you.

Common questions
Who can file on MSME Samadhaan?
A micro or small supplier under section 2(n) of the MSMED Act, registered before the order. The pack uses the same checks as the demand notice, so it declines a medium enterprise or a certificate that lists trade.
Do I send a notice first?
The demand notice is the usual first step, and it states that you will refer the matter to the Council under section 18. The pack builds the application for the reference.
What if the order was oral?
Choose oral in the form and the pack adds an affidavit about the order, which the Samadhaan FAQ asks for.
Does one pack cover several invoices?
No. One pack covers one invoice, so file a pack for each invoice you are claiming.
Can I see the document before I pay?
Yes. Fill in your details and the page shows the first page of each document with your own answers in it. You pay only if it is what you need.
Can I change the document after I download it?
Yes. Each document comes as a Word file you can edit and a PDF you can print. You can also change your answers and prepare it again before you pay.
What if the payment goes through and the documents do not open?
The page checks the payment again and opens the documents on the same payment, so you are never charged twice. If they still do not arrive, write to us within 7 days and we refund the full amount.
Can you send or file it for me?
Yes. After you download, ask us to take the next step and we handle the sending or filing for you.
