Why this varies so much by state

There's no central Shops & Establishment portal. Each state and union territory runs its own Act, its own online (or partly offline) filing process, and its own fee structure. A checklist that's accurate for Karnataka can be wrong for Delhi, which is why we confirm your state before preparing anything.

Who needs this

In Delhi, Karnataka, and Maharashtra, registration is required regardless of employee count, including home-based businesses and e-commerce operations that hold a warehouse. Establishments registered as factories under the Factories Act, 1948 are generally exempt.

Holding GST or Udyam registration doesn't cover this. They're issued by different regulators for different purposes, and a business with both can still be legally required to register under the Shops & Establishment Act.

Yes. Shops & Establishment registration is a labour-law registration from the state labour department. GST and Udyam are issued by different regulators for different purposes, and neither substitutes for it.

In Delhi, Karnataka, and Maharashtra, no. Registration is required regardless of employee count. Employee count does affect the fee slab and, in some states, the renewal terms.

A home-based business with a registered address is still in scope in the states we currently cover, the same as a leased office.
